The preliminary injunction issued last week by the Fuzhou Intermediate People's Court in China concerns models originally carrying older versions of Apple's iOS operating system from the iPhone 6S to the iPhone X. It was not clear whether the ruling involved a model with Apple's newer operating system. Apple says all models are still available in China. Apple's three models released in September were not affected by the case.
China, Hong Kong and Taiwan are Apple's third largest markets, accounting for about a fifth of Apple's revenue of $265.6 billion in the latest fiscal year.
China's ruling is part of a global patent war between Qualcomm and Apple, which have filed numerous patent lawsuits in dozens of jurisdictions around the world. Qualcomm also asked U.S. regulators to ban the import of several Apple iPhone models on patent grounds, but so far, U.S. officials have refused to do so.
Qualcomm filed a lawsuit in China at the end of 2017, claiming that Apple infringed on its patents related to image size re-editing and touch screen application management functions.
Apple responded that "Qualcomm's search for a ban on our products is a desperate move by the company, whose violations are being investigated by global regulators."
** Function-specific litigation**
Don Rosenberg, Qualcomm's general legal adviser, said in a statement that the Chinese court's ruling is now in force and applies to specific functions rather than operating systems.
