United Parcels (UPS. N) said Tuesday it would not take part in a lawsuit filed by Federal Express (FDX. N) against the U. S. government. FedEx filed a lawsuit against the U.S. government Monday, saying the company should not be held responsible for unintentionally transporting products that violate the Trump government's export ban.
FedEx had previously returned a package containing Huawei's mobile phone to a shipper in the United Kingdom last week, triggering renewed anger in China, which FedEx interpreted as a "misoperation".
The U.S. Department of Commerce blacklisted Huawei Technologies Ltd. and its 68 branches in more than 20 countries last month, a move that would prohibit the telecom giant from buying parts from U.S. companies without the approval of the U.S. government. Several other Chinese companies have also been banned from buying sensitive American technology.
FedEx said in its lawsuit that it should not be expected to impose an export ban on the company, and that it was unreasonable to hold the company responsible for transporting goods it did not know about.
Wilbur Ross, the U.S. commerce secretary, said in a statement that regulatory requirements require shippers not to deliberately transport illegal goods. "The rule does not require an ordinary carrier to act as a policeman or to know what goods are in each package," he said.
In a statement Tuesday, UPS said it would continue to comply with government directives in all operating markets.
